    1. By completing and submitting this form (“Submission”) you are providing your Submission to Asia Miles Limited (“AML”) for the purpose of Cathay Member Stories. Asia Miles Limited, a wholly owned subsidiary of Cathay Pacific Airways Limited (“Cathay Pacific”), manages and operates the Cathay Membership Programme (“Cathay”).
    2. By submitting this form, you are deemed to have read, fully understood and agreed to these Terms and Conditions.
    3. You must be a current member of Cathay (“Member”) residing in Hong Kong, and not be in breach of the Cathay Terms and Conditions to make a Submission.
    4. You must be of legal age on the date of making your Submission.
    5. Any incomplete, inaccurate or false information found will result in disqualification of your Submission without explanation or notification by AML.
    6. Upon AML’s request, you must be able to demonstrate that you have complied with these Terms and Conditions.
    7. Once a Submission is submitted, it cannot be modified. Submissions will not be returned to you.
    8. By submitting your Submission, you represent and warrant to AML that you own all rights in and to your Submission, and that your Submission is your original work and does not include any unauthorised third-party material or material generated by AI. You further represent and warrant to AML that your Submission will not infringe on the rights (including intellectual property rights, rights of privacy or confidentiality) of any other parties.
    9. You must not make any Submission that contains any obscene, vulgar, sexually explicit, violent, defamatory, libellous, indecent, racist, political, inaccurate, false, misleading, disparaging or otherwise controversial or inappropriate content, or any content that is an infringement of any intellectual property rights of a third party, or would otherwise violate or encourage the violation of any law or the proprietary or other rights of any third party (collectively the “Improper Content”).
    10. You will be responsible for any legal liability that may arise if your Submission contains any Improper Content or violates any laws, and any liability that may arise for any breach of your obligations under these Terms and Conditions and any consequences of such breach of these Terms and Conditions and/or violation of law, including any loss or damage which AML, Cathay Pacific or any third party may incur or suffer.
    11. AML will select certain Submissions for publication. AML has sole and absolute discretion to decide which Submissions will be selected for publication. AML will not provide any explanation or prior notice for its decision to select certain Submissions.
    12. If your Submission is selected for publication by AML, AML reserves the right to request that you provide further information regarding your Submission including without limitation, to clarify details about your Submission such as the travel destination, the experience, and/or any specific locations mentioned or not mentioned in the Submission (“Additional Information”).
    13. You agree and hereby grant to AML an unlimited, perpetual, irrevocable, assignable, sub-licensable , royalty-free license to reproduce, distribute, create derivative works of edit, alter, publish, display, exhibit, translate, communicate, combine with other materials, exploit and otherwise use the Submission submitted by you together with any Additional Information in connection with Cathay Member Stories (and agrees to waive all moral rights thereto), and all elements embodied therein, in whole or in part, including your name and location information you may have included in your Submission and any Additional Information, in any manner and in any and all media now known or hereafter devised (including on the Cathay Pacific website, social media pages, mobile apps, digital media pages, print materials (including without limitation the Cathay Pacific’s inflight magazine)) throughout the universe for any purpose whatsoever, including, without limitation, for commercial purposes, without compensation or notification to, or permission from, entrant or any third party.
    14. To the fullest extent permitted by law, AML reserves the right to change these Terms and Conditions and other requirements, including terminating Cathay Member Stories in whole or in part, at any time without prior notice.
    15. AML assumes no responsibility for any error, omission, interruption, deletion or missing of data, defect, or delay in transmission of the Submission, any failure or technical malfunctions of communications systems or computer systems or the internet, or theft or destruction of any Submissions, failure of any computer equipment, failure of any software, any injury or damage to your computer resulting from or relating to your making of or provision of your Submission to AML.
    16. To the fullest extent permitted by law, AML does not make any representation or warranty:
      a. that the submission form and ability to make a Submission is available to you at any time and without disruption, interruption or delay;
      b. that any information obtained by you as a result of submitting your Submission will be suitable, accurate, complete or reliable; and
      c. that any deficiencies in the submission form, including any defects in its performance, operation or functionality, will be fixed, corrected or otherwise remedied
    17. AML is not liable to you, in particular whether in contract, tort (including negligence) or any theory of liability in connection with your making of your Submission for:
      a. any indirect, incidental, special or consequential losses or damages;
      b. any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);
      c. any damage to and/or corruption or loss of data (where direct or indirect); and
      d. any changes, modifications, extensions or limitations of Cathay Member Stories.
    18. Nothing in these Terms and Conditions shall exclude or limit AML’s:
      a. You understand and agree to AML’s use of personal data for the purposes of Cathay Member Stories and such use to be in accordance with the Cathay Pacific Privacy Notice.
      b. any warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law;
    19. Personal Data
      You understand and agree to AML’s use of personal data for the purposes of Cathay Member Stories and such use to be in accordance with the Cathay Pacific Privacy Notice.
    20. These Terms and Conditions are governed by and construed in accordance with the laws of Hong Kong.
    21. Any dispute arising out of or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
    22. These Terms and Conditions are in the English language and have been translated into Traditional Chinese. If there are any inconsistencies between the English language version and the Traditional Chinese language version, the English version will prevail.
