Year of the Rabbit Soft Toy Competition - Official Rules

“Year of the Rabbit Soft Toy Competition”, brought to you by Cathay Pacific Airways Limited 國泰航空有限公司 (“Cathay Pacific” for short) will be governed by these rules (the “Official Rules” for short). The promotion is in no way sponsored, administered or endorsed by Facebook, Instagram or Twitter. All information provided is provided to Cathay Pacific. 

  1. Eligible participants must be at least 18 years of age & be a resident of Australia (“Participants” for short).
  2. Employees and directors of Promoter and its licensees, advertising, promotion or production agencies and provider companies (and their respective dependents, immediate family members and individuals residing in their same household) are not eligible to participate.
  3. The Promoter and its associated companies reserve the right, at any time, to verify the eligibility of Participants.
  1. The competition begins on 12:00pm (AEDT) Sunday February 5, 2023 and will run until 11:59pm (AEDT) Sunday February 12, 2023 (the “Competition Period” for short).
  1. The competition will take place on Cathay Pacific’s Facebook page. 
  2. During the competition period, one (1) question in regard to the audience’s next overseas travel destination for 2023 will be asked. This question will invite users to share their personal opinion. The question will be posted on Cathay Pacific Facebook. To enter the competition, users must then answer the question asked on the Cathay Pacific Facebook page by leaving a comment on the post.
  3. Only one (1) entry per person is permitted. Any subsequent entry of an Entrant after the first valid entry is received from that Entrant will be deemed invalid.
  4. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible Entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected Entries.
  1. Promoter respects the privacy of its customers and the information submitted by the Participant to the Promoter will only be used by Promoter, in accordance with the Participant’s instructions upon entry and with applicable data protection regulations and the Promoter’s online privacy policy (the “Privacy Policy“) available on their website. 
  2. Any information submitted within Facebook will be governed by the privacy policy of Cathay Pacific Airways and Facebook. Please consult Cathay Pacific’s Privacy Policy and/or Facebook privacy policy for more details on how Promoter/Facebook handles information submitted by you (“Personal Information” for short).
  1. There will be ten (10) winners. These winners will receive a prize consisting of one (1) Cathay Pacific “Year of the Rabbit soft toy” set which includes one regular and one miniature-sized rabbit.
  2. NO PRIZE WINNER HEREUNDER SHALL BE PERMITTED TO (A) REPLACE HIS/HER DESIGNATED PRIZE WITH ANOTHER PRIZE OR ITEM, (B) TRANSFER OR ASSIGN HIS/HER DESIGNATED PRIZE TO ANOTHER PERSON, OR (C) REDEEM HIS/HER PRIZE FOR CASH. PROMOTER RESERVES THE RIGHT, EXERCISABLE AT ANY TIME IN THEIR SOLE DISCRETION, TO SUBSTITUTE A PRIZE (OR PORTION THEREOF), PROVIDED THAT THE SUBSTITUTE PRIZE IS AN ITEM OF COMPARABLE OR GREATER VALUE. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESSED OR IMPLIED BY THE RELEASED PARTIES. ALL PRIZE DETAILS ARE AT PROMOTER’S SOLE DISCRETION. ANY COSTS AND EXPENSES ASSOCIATED WITH PRIZE ACCEPTANCE AND USE NOT SPECIFIED HEREIN AS BEING PROVIDED ARE EACH WINNER’S SOLE RESPONSIBILITY, INCLUDING ANY AND ALL FEDERAL, STATE AND LOCAL TAXES.
  1. Ten (10) winners will be selected from the pool of answers submitted by the community from the one (1) question asked. The promoter will randomly draw ten (10) winners from this pool, the draw will take place at Level 29, Tower One, 100 Barangaroo Ave, Barangaroo NSW 2000.  Each winner decision is final and no correspondence will be entered into. The Promoter may draw five (5) additional reserve entries and record them (in order) in case an invalid Entry or ineligible Entrant is drawn or the Entrant is ineligible or declines to accept a prize.
  2. The winners will be decided at 4pm (AEDT) on 14 February 2023, and all winner will be published on https://www.facebook.com/cathaypacific/ on 14 February 2023. These winners will also be notified directly via Facebook Messenger within 24 hours of the Promoter’s decision. 
  3. This winning notification will include an email address to contact with an identity confirmation test. After receiving a winning notification, Participants must confirm their identity, proof of age and contact details via email within 72 hours of their notification (72 hours excludes weekend). 
  4. If the winner fails to contact the Promoter within the 72 hour period (72 hours excludes weekend), the winner shall forfeit the Prize. In this event, Promoter shall award the prize to the next eligible participant or dispose of the Prize in any way deemed fit.
  5. Prizes will be dispatched on or before Tuesday February 21, 2023.
  6. To the fullest extent permitted by law, the Promoter shall not be liable for any direct, indirect or consequential loss or damages whatsoever which is suffered in relation to the delivery of the Prize to the winner and/or this Promotion.
  1. By taking part in this competition, Participants consent to comply with these Official Rules and the Privacy Policy. 
  2. By submitting content and taking part in this competition, Entrants consent to comply with these Terms & Conditions and the Privacy Policy, and represent that they fulfill all the requirements to enter this competition, as set out in these Terms & Conditions.
  3. Each entrant also warrants and represents that all personal data provided for the purposes of entering into the competition are true & accurate and that they have full power and authority to submit the entry.
  4. Other than for death or personal injury arising from negligence of the Promoter or for anything else that cannot be excluded by law, so far as is permitted by law the Promoter excludes all liability for any disappointment, loss, damage, injury, cost and expense, whether direct or indirect, howsoever caused in connection with the Promotion or any aspect of the Prize.
  5. If a winner is found to be ineligible or not in compliance with these Official Rules the winner’s Prize will be forfeited and an alternate winner selected.
  6. No purchase is necessary to participate in this competition.
  1. Content from this promotion will be used by the promoter on the Cathay Pacific website and for the purposes of promoting Cathay Pacific or the Competition, now and into the future, at no cost to the Promoter. The entrant also agrees to allow the Promoter to use their photo for printed collateral, online, in store and across other marketing, advertising and communications mediums, at Promoter’s sole discretion and at no cost, under their Cathay Pacific or Resident of the World brands. 
  2. By submitting, and upon such submission of, any information or materials including (but not limited to) data, text, photographs, likeness, messages or user details, or any other material (the “Content” for short) to the Promoter or through the Site, you license and grant to the Promoter a non-exclusive, royalty-free and free of charge, perpetual, worldwide, irrevocable, and fully sub-licensable right to use, reproduce, copy, modify, adapt, communicate to the public, make available, publish, translate, create derivative works of, distribute, and display such Content or any concept described in it throughout the world in any media, product and/service so that the Promoter may make the fullest use of the Content, without compensation, or any restrictions on use, accountability or liability, and with waiver of all moral rights to the extent permitted by applicable laws. 
  3. With regard to such Content submissions, you understand and agree that you are solely and fully responsible for any and all aspects of the Content submitted, including but not limited to its legality, appropriateness and non-infringement of third party intellectual property rights, and the Promoter shall not be liable in any way for such Content. In submitting a photo and text for entry, the entrant declares that they have taken the photo or written the content, and own and have sole and complete intellectual property rights to all content. The entrant will indemnify the Promoter against any claim, loss or costs incurred by the Promoter where a third party claims ownership of the rights to any piece of content. The Promoter reserves the right to request proof of photo ownership. 
  4. You also acknowledge and understand that any submitted Content may be visible to anyone, anywhere.
  5. The Promoter will have full moderation over entries submitted to ensure suitability and appropriateness for the contest. Inappropriate content includes, but is not limited to, content that is offensive, discriminative, lewd, and violent or any other content deemed inappropriate to display by Cathay Pacific. Any content deemed inappropriate by the Promoter will be considered a breach of these terms and conditions, and render the entry ineligible for consideration. By submitting the photo and text, the entrant declares that they have the permission of all individual(s) captured in photo(s) to share and publish their image.
  6. The Promoter may expect the winner of the Promotion to take part in reasonable public relations activities and promotional events promoting Promoter products. Any appearance made by the winner will be subject to a separate agreement made between Promoter and the winner.
  1. Neither Promoter nor its associated companies can accept any responsibility for lost, late, damaged, misdirected, unintelligible, or interrupted entries, which shall be deemed invalid. Proof of submission of entry will not constitute proof of receipt of entry.
  2. To the fullest extent permitted by applicable law, the Promoter is not responsible for loss or damage to Participants’ or to any other person’s computer related to or resulting from participating in the Promotion or downloading materials from or use of the Site. Should any portion of the Promotion be, in the Promoter’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Promoter, corrupt or impair the administration, security, fairness or proper play, or submission of entries, the Promoter reserves the right at its sole discretion to suspend, modify or terminate the Promotion, and select the winner at random from all entries received prior to action taken or as otherwise deemed fair and appropriate by Promoter.

  2. To the maximum extent permitted by applicable law, the Promoter reserves the right at its sole discretion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event Promoter shall not have any liability whatsoever.
  3. You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of the Promoter, will immediately be disqualified from the Promotion. Cheating includes, but is not limited to, tampering, hacking of website, entering the Promotion without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Promotion, exploiting any software bugs, use of the Promotion beyond the defined rules of the Promotion, attempting to disable or overwhelm any of the Promoter sites, attempts to disrupt any portion of the Promotion, including, but not limited to, allowing somebody else use your Personal Information, tampering with entry process or operation of promotion or Site.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE PROMOTER SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  5. You acknowledge and agree that all disputes in relation to the Promotion shall be determined in the sole and absolute discretion of Promoter, and that such a decision shall be final and binding.
